These Terms and Conditions (“Terms”) govern your use of the website located at
www.eugeneperio.com (“Site”), operated by Andrew N Dow DMD PC,
doing business as Eugene Periodontics & Implant Dentistry (“we,” “us,” or “our”),
a periodontal dental practice located in Eugene, Oregon. By accessing or using the Site, you agree
to be bound by these Terms. If you do not agree, please do not use the Site.
1. Description of Services
Eugene Periodontics provides information about our dental practice and services to patients and
the community through this Site. We also operate an internal employee payroll notification program
(“Eugene Periodontics Payroll”) that sends SMS text messages and emails to employees regarding
monthly timesheets, hours worked, paid time off balances, and draw verification reminders.
2. Eligibility
This Site and its associated services are intended for use by individuals 18 years of age or
older. By using the Site, you represent that you are at least 18 years old.
3. No User Accounts
The Site does not currently offer user account registration. No personal account creation is
required or available to visitors of the Site.
4. Prohibited Activities
You agree not to use the Site for any unlawful purpose or in any way that could damage, disable,
overburden, or impair the Site, or interfere with any other party’s use of the Site. Prohibited
activities include attempting to gain unauthorized access to any portion of the Site, using automated
means to access the Site without our express written permission, and any activity that violates
applicable local, state, national, or international law.
5. SMS Text Messaging Program
Eugene Periodontics operates an SMS text messaging program called “EPID Payroll
Notifications” for the purpose of sending operational and administrative notifications to
our employees, including:
- Monthly timesheet summaries and approval requests
- Draw verification reminders
- Attendance and payroll-related notices
Employees are enrolled in this program by providing their mobile phone number to the Office
Manager during the employment onboarding process, as a condition of employment. Message frequency
is up to two (2) messages per month. Message and data rates may apply.
Opt-Out: You may opt out of receiving SMS messages at any time by replying
STOP to any message received, or by notifying the Office Manager directly. After
opting out, you will receive a one-time confirmation message and will not receive further messages
unless you opt back in.

Carriers are not liable for delayed or undelivered messages. Supported carriers include, but are
not limited to, AT&T, Verizon, T-Mobile, and Sprint.
6. Links to Third-Party Websites
Our Site may contain links to third-party websites or services that are not owned or controlled
by Eugene Periodontics, including social media platforms and mapping services. We have no control
over, and assume no responsibility for, the content, privacy policies, or practices of any
third-party websites or services. You acknowledge and agree that we shall not be responsible or
liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in
connection with the use of any such content, goods, or services available through any such
third-party websites.
7. Disclaimer of Warranties
The Site and all content, information, and services provided through it are offered on an “as is”
and “as available” basis without warranties of any kind, either express or implied.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Eugene Periodontics shall not be liable for
any indirect, incidental, special, consequential, or punitive damages arising out of or related to
your use of the Site.
9. Dispute Resolution
If a dispute arises between you and Eugene Periodontics, our goal is to resolve it informally
through good-faith negotiations. The parties agree to engage in informal negotiations for a period
of at least thirty (30) days before initiating any arbitration proceeding.
If a dispute cannot be resolved through informal negotiations, it shall be resolved through
binding arbitration, to be held in the State of Oregon, United States. Eugene Periodontics agrees to
pay arbitration fees that would otherwise be deemed excessive for the claimant to bear, where
required by applicable arbitration rules.
If for any reason a dispute proceeds in court rather than arbitration, the dispute shall be
brought in the appropriate courts located in the State of Oregon, and the parties consent to venue
and personal jurisdiction there.
10. Updates to These Terms
We may update these Terms from time to time. We will notify users of material changes by updating
the “Last updated” date at the top of this page. We encourage you to review these Terms periodically.
